These terms and conditions (Terms) set out the basis on which you, the customer (Customer), may make use of the MarketPlace Arts website (www.marketplacearts.org.uk) to purchase tickets (including free tickets) for organised events. MarketPlace Arts is the trading name of MarketPlace Arts of March Town Hall, March, Cambridgeshire, PE15 9JF (registered under charity number 800929).

To book tickets to any events you must be 16 years or over (but please be aware of the age restrictions that may be applicable to any specific event). By continuing to use the website, you represent that you are 16 years or over and you expressly agree to be bound by these Terms and to follow all applicable laws and regulations governing the website. 

MarketPlace Arts reserves the right, at its sole discretion, to change these Terms at any time, effective immediately upon posting on the website so please check the website regularly for any updates. If you violate these Terms, MarketPlace Arts may terminate your use of MarketPlace Arts’ services, bar you from future use of the website and/or take appropriate legal action against you.

1. Who we are

MarketPlace Arts sells tickets to their events directly to Customers via the website. The contract of sale is between you and MarketPlace Arts. 

2. Intellectual property rights

All intellectual property rights (which includes rights such as copyright, and rights in trade marks) in any content of the website (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned by MarketPlace Arts and/or its licensors.

Except as expressly set out in these Terms, nothing in these Terms gives you any rights in respect of any intellectual property owned by MarketPlace Arts or its licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the website. If you print off, copy or store pages from the website (only as permitted by these Terms), you must ensure that any copyright, trade mark or other intellectual property right notices contained in the original content are reproduced.

3. Service access

While MarketPlace Arts endeavours to ensure that the website is normally available 24 hours a day, MarketPlace Arts shall not be liable if for any reason the website is unavailable at any time or for any period.

Access to the website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

5. Purchasing tickets

MarketPlace Arts makes use of various ticketing platforms for the handling of all event bookings and does not run its own box office system. When booking for any MarketPlace Arts event, separate Terms & Conditions may apply as set by the ticketing platform (i.e Ticket Tailor, Eventbrite) 

5.1 Order Confirmation

Order confirmation will usually take the form of a summary web page at the end of the purchase sequence which will be followed by a confirmation email. Both contain details of the tickets purchased and a unique purchase reference number, which acts as your proof of payment.

Tickets cannot be sold or exchanged to any other persons and you may be asked to produce identification confirming that you are the person identified on the ticket.

6. Exchanges and refunds

By default tickets purchased for MarketPlace Arts events are non-refundable. 

8. Cancellation of an event

Where MarketPlace Arts needs to cancel an event then MarketPlace Arts will use its best endeavours to contact you by email (using the details provided at the time of booking) advising you of the cancellation and initiating any process to re-book tickets, if applicable. 

9. Event postponed or change of venue

Where MarketPlace Arts needs to postpone an event or make a venue or location change then MarketPlace Arts will use its best endeavours to contact you by email (using the details provided at the time of booking) advising you of the postponement or venue change

10. Price

The price of tickets is as quoted on the website. Prices include VAT, booking and credit card fees, if applicable.


Prices are liable to change at any time, but changes will not affect ticket purchases in respect of which we have already sent you an email confirmation.

11. Ticketing Platform and event specific terms and conditions

Tickets are sold subject to these Terms as well as any applicable individual event or ticketing platform terms and conditions, including age restrictions, refund and exchange policy. If an event or venue has its own terms and conditions, they will be provided to you before the point of your purchase.

Please read the applicable additional terms and conditions before completing your booking. 

Please be aware that you may be refused entry to an event if you are deemed to be drunk or intoxicated in any way and will have no right to a refund.

12. Your data


In respect of any personal data (as defined in the Data Protection Act 2018 (Act)) MarketPlace Arts is responsible for complying with the Act and continuing to comply with any future amendments to the Act and any guidance by the Information Commission.

By purchasing a ticket, you agree that MarketPlace Arts will share your data with any partner of the event if necessary to facilitate organisation of the event.

Subject to all applicable data protection legislation and the terms of our Privacy Policy, your personal data generated in connection to your purchase of tickets via the website shall be owned jointly by MarketPlace Arts and and any other partner organisation and, subject to any relevant consents being granted by you under the Act, each party shall be entitled to use your data to facilitate the ticketing service.

13. Warranties

The website and its content are delivered on an “as-is” and “as-available” basis.

MarketPlace Arts does not guarantee that the website will be error-free, uninterrupted, or that it will provide specific results from any content, search or link on it.

MarketPlace Arts cannot ensure that files you download from the website will be free of viruses or contamination or destructive features.

14. Limitation of liability

This clause 14 sets out MarketPlace Arts’s entire liability to you under or in connection with this agreement.

Nothing in these Terms limits or excludes MarketPlace Arts’s liability for:

  • death or personal injury caused by its negligence; or
  • fraud or fraudulent misrepresentation.

Subject to the above, MarketPlace Arts will not have any liability to you under or in connection with this agreement for any:

  • loss of profits or account of profits;
  • loss of sales or business;
  • loss of agreements or contracts;
  • loss of opportunity;
  • loss of anticipated savings;
  • loss of or damage to goodwill;
  • loss of use or corruption of data or information; or
  • any indirect or consequential loss.

Subject to the above, MarketPlace Arts’s total liability to you under or in connection with these Terms will be limited, in respect of all claims (connected or unconnected) in any consecutive 12 month period, to an amount equal to the total sum of money paid by you via the website in that period.

14.1 Covid 19

‘Covid-19’ means: the global outbreak of the respiratory coronavirus disease known as COVID-19 and the virus known as severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) (and any subsequent waves or derivatives of the same). There is a risk of the transmission of Covid-19 in any environment where people come together, which is increased in enclosed spaces with an increased number of people.

By purchasing tickets to an event via the website, you accept that neither MarketPlace Arts nor any Event Partners can guarantee that you will not be exposed to Covid-19. You voluntarily accept the risk of being exposed to, contracting or spreading Covid-19. You agree that MarketPlace Arts and any Event Partners are not responsible or liable for any injuries, sickness, or death resulting from such causes.

You agree to:

  • comply with all health and safety protocols implemented by MarketPlace Arts and any Event Partners (which can be amended at any time according to the latest guidance or legislation, or as otherwise deemed necessary). These protocols may be communicated to you via various channels including but not limited to the website, venue signage, the MarketPlace Arts event listing or as instructed by venue staff at the event;
  • abide by all current and relevant government guidance aimed at preventing the transmission of Covid-19; and
  • Not to enter the venue or event if you believe you may have been infected with Covid-19.

15. Your privacy

We believe that the privacy of all our Customers is important, please refer to our Privacy Policy for full details.

16. Applicable law and jurisdiction

These Terms are governed by English law and you agree that the courts of England shall have exclusive jurisdiction over any dispute or claim that arises out of or in connection with these Terms.
